Terms of Service
Last updated November 2, 2026
1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between PainterOS ("PainterOS," "we," "us") and the business that signs up for PainterOS ("you," "client"). They cover our website at getpainteros.com, the PainterOS app at app.getpainteros.com, and all of the services we provide (together, the "Service").
By signing up, paying for, or using the Service, you agree to these Terms. If you're agreeing on behalf of a business, you confirm you're authorized to do so. If you don't agree, please don't use the Service.
2. The Service
PainterOS helps residential painting contractors win more jobs. Depending on your plan, the Service may include:
- An AI assistant that answers calls you miss, talks with callers, and books estimates on your calendar.
- Automated follow-up by text and phone with new leads and open quotes.
- Google review requests after completed jobs.
- The PainterOS app, with your schedule, pipeline, quotes, jobs and numbers, and a monthly scorecard.
The Service runs on third-party platforms, including GoHighLevel, phone carriers, and AI providers (see section 10). We may improve, change or replace features over time. If we remove something central to what you're paying for, we'll tell you in advance.
3. Your account
- The Service is for businesses. You must be at least 18 and able to enter into a contract.
- Give us accurate information and keep it up to date, including your business details, service area, hours, and anything the assistant should say about your business.
- You're responsible for everyone you give a login to (office staff and crew) and for keeping passwords private. Tell us right away if you think your account has been misused.
4. Plans, billing and cancellation
You don't pay until PainterOS wins you a job
There's no charge until the Service helps you win your first signed job. A job counts when a customer the Service answered, followed up with, or booked signs on with you, and you mark that job won in PainterOS. Your paid plan and your 90-day guarantee period both start on that date (the "Start Date").
Your plan
Your monthly price is the one in the proposal or order you accept when you sign up, and it's based on the size of your business. If your business grows or shrinks enough to change plans, we'll talk with you before anything changes, and a change only applies from your next billing date.
Payment
- Plans are billed monthly in advance, starting on the Start Date, to the payment method on file. Prices don't include taxes, which are added where required.
- If a payment fails, we'll let you know. If it isn't fixed within 14 days, we may pause the Service until it is.
- We may change prices with at least 30 days' notice. A change never applies to a month you've already paid for.
Cancelling
There's no long-term contract. You can cancel at any time by emailing us. Cancellation takes effect at the end of the month you've paid for, and the Service keeps running until then. Apart from the guarantee in section 5, payments are non-refundable and we don't give refunds for partial months.
5. The 90-day guarantee
If, during the 90 days after your Start Date, the jobs PainterOS helps you win don't add up to more than you've paid us, we'll refund every dollar you've paid for the Service.
How it's measured
- Jobs won means the total contract value of jobs you mark won in PainterOS during the 90 days, where the customer was answered, followed up with, or booked by the Service.
- What you've paid means the plan fees you paid us for those 90 days.
To qualify
- Reply to interested customers within 24 hours when the Service lets you know they're ready.
- Mark jobs won or lost in PainterOS, accurately and promptly.
- Keep notifications on so you know when you're needed.
- Ask for the refund by email within 30 days after your 90-day period ends.
We'll confirm the numbers from your PainterOS records and send the refund to your original payment method within 14 days of confirming. You keep everything set up during the 90 days, including your follow-up system, your organized pipeline and every review collected. The guarantee applies once per business.
6. Your responsibilities
- Your work and your promises. You're responsible for your painting work, pricing, estimates, warranties, scheduling and anything you or your team promise customers. PainterOS isn't a party to your contracts with your customers.
- Being reachable. The Service brings customers to you. You need to respond when a customer is ready to decide.
- Licenses and insurance. You're responsible for holding any licenses, registrations and insurance your work requires.
- Accurate information. Keep the details the assistant uses (services, hours, service area, policies) accurate, and tell us when they change.
7. Calls, texts and consent
The Service calls and texts people on your behalf, and laws such as the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state telemarketing laws and call-recording laws apply. You agree that:
- You'll only have the Service contact people who have given you permission to contact them, such as people who submitted a request, called you, or are your customers, and you have the consent the law requires for the type of message.
- You won't upload or have us contact purchased, rented or scraped lists.
- Opt-outs are honored. When someone replies STOP or asks not to be contacted, the Service stops contacting them, and you won't add them back.
- Calls may be recorded. Callers are told calls are recorded where the law requires it, and the assistant is honest that it's a virtual assistant when asked.
- You'll help with the registrations carriers require for business texting (such as A2P 10DLC brand and campaign registration), including providing accurate business information.
Text message terms
Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how mobile information is handled.
8. AI features
Parts of the Service use artificial intelligence to talk, write and summarize. AI can make mistakes, misunderstand callers, or say something inaccurate. We work to keep the assistant accurate and on script, but you should review important details (such as appointment times, addresses and anything a customer asks about price) and correct anything that's wrong. Except for the guarantee in section 5, we don't promise any particular number of calls, bookings, jobs or revenue.
9. Your data
- You own your data: your business information and your customers' information.
- You give us permission to use it only to provide, support and improve the Service for you, as described in our Privacy Policy and the app privacy policy.
- We never sell your data or share your customers with other clients.
- When you leave, you can ask for an export of your data within 30 days. After that we delete it, as described in the Privacy Policy.
10. Third-party services
The Service depends on services we don't control, including GoHighLevel/LeadConnector, phone carriers, Calendly, Google, Anthropic, ElevenLabs and Vercel. Their own terms may apply to parts of the Service, and their outages, policy changes or carrier filtering can affect it. We'll work to keep things running and tell you about significant problems, but we're not responsible for third-party failures.
11. Acceptable use
You agree not to use the Service to:
- Break any law, including telemarketing, consumer-protection, privacy and anti-spam laws.
- Send messages that are misleading, harassing, hateful, or that impersonate someone else.
- Collect or contact people without the permission described in section 7.
- Copy, resell, reverse-engineer or interfere with the Service, or try to access other clients' data.
12. Intellectual property
PainterOS, including the app, the assistant's scripts and setup, our software, designs and content, belongs to us and our licensors. While you're a client, we give you a limited, non-transferable right to use the Service for your business. Your logo, photos and business content stay yours; you let us use them to provide the Service (for example, in messages sent for you). If you send us feedback, we can use it to improve PainterOS without owing you anything.
13. Disclaimers
Except as stated in these Terms, the Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted or error-free.
14. Limitation of liability
To the fullest extent the law allows, neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if told they were possible. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose. These limits don't apply to your payment obligations, your responsibilities in section 7, or your indemnity in section 15.
15. Indemnity
You'll defend and hold PainterOS harmless from claims, fines and costs (including reasonable legal fees) arising from your painting work, your dealings with your customers, contact lists or consent you provided, or your breach of these Terms or the law.
16. Suspension and termination
You can stop using the Service and cancel at any time (section 4). We may suspend or end the Service if you materially breach these Terms, don't pay, or use the Service in a way that risks legal harm to us, carriers or other people. Where reasonable, we'll warn you first and give you a chance to fix the problem. Sections that by their nature should survive (including payment owed, data export, disclaimers, liability limits and indemnity) survive the end of these Terms.
17. Disputes
If something goes wrong, email us at skyler@getpainteros.com first. Most problems can be solved quickly that way. If we can't resolve a dispute within 30 days, either party may bring a claim in the state or federal courts located in Texas, and both parties agree to those courts' jurisdiction. These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules.
18. Changes to these terms
We may update these Terms. If we make a significant change, we'll email active clients at least 30 days before it takes effect. Continuing to use the Service after that means you accept the updated Terms. If you don't, you can cancel before the change takes effect.
19. Everything else
These Terms, together with any order or proposal we both agree to in writing, are the whole agreement between us about the Service. If a written proposal conflicts with these Terms, the proposal wins for that point. If any part of these Terms can't be enforced, the rest still applies. Not enforcing a right isn't a waiver of it. You can't transfer these Terms without our consent; we may transfer them as part of a merger or sale of our business.
